OVERVIEW

These Terms of Service ("Terms") govern your use of the MORGVN website and your purchase of products and services from MORGVN.

Throughout these Terms, "MORGVN," "we," "us," and "our" refer to MORGVN. "You" and "your" refer to the person accessing the website, placing an order, or purchasing products or services.

By accessing our website or purchasing from MORGVN, you agree to these Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy.

1. ONLINE STORE TERMS

You may use this website and purchase products only for lawful purposes.

You may not use our products, services, website, images, designs, or other materials for any unlawful or unauthorized purpose or in violation of applicable laws.

2. PRODUCT INFORMATION

We make reasonable efforts to accurately describe and photograph our jewelry.

Fine jewelry is inherently individual. Natural gemstones, diamonds, pearls, hand-fabricated components, hand-applied finishes, and other materials may exhibit variations in color, texture, inclusions, pattern, dimensions, weight, or appearance.

These variations are part of the nature of handcrafted jewelry and natural materials and are not necessarily defects.

Computer and mobile displays may also represent colors differently.

Carat weights, dimensions, measurements, and other specifications identified as approximate may vary within reasonable tolerances.

3. ORDERS & ACCEPTANCE

Placing an order constitutes an offer to purchase from MORGVN.

MORGVN reserves the right to accept, decline, hold, limit, or cancel an order in our reasonable discretion, including when an order cannot be satisfactorily verified, a product is unavailable, pricing or product information contains an error, or the transaction presents an elevated risk of fraud or unauthorized use.

An order confirmation, payment authorization, or automated email does not necessarily constitute final acceptance of an order.

We may request additional information, an alternate shipping address, or an alternate payment method before accepting or fulfilling an order.

We reserve the right to limit quantities and to decline purchases that reasonably appear to be intended for unauthorized commercial resale or redistribution.

International purchases are permitted only in accordance with our Shipping Policy.

4. PRICES & PAYMENT

Prices are displayed in U.S. dollars unless otherwise indicated.

We reserve the right to correct pricing, typographical, or product-information errors.

You agree to provide current, complete, and accurate billing, payment, and contact information.

By providing a payment method, you represent that you are authorized to use it for the transaction.

Payment authorization does not necessarily constitute final acceptance of an order.

MORGVN may require an alternate payment method for certain transactions.

Available payment methods may include credit or debit cards, PayPal, bank transfer, or other payment methods made available by MORGVN.

For bank transfers or other manually processed payments, an order will not enter production or ship until payment has been received and confirmed, unless otherwise agreed in writing.

5. ORDER VERIFICATION & FRAUD PREVENTION

MORGVN may use information associated with an order to verify the payment, purchaser, billing information, recipient, shipping address, and other transaction details.

We may use Shopify, payment processors, financial institutions, fraud-prevention services, carriers, insurers, and other service providers to assist with transaction verification and security.

We reserve the right to hold, decline, or cancel orders that cannot be satisfactorily verified or that present an elevated risk of fraud, unauthorized use, or loss.

We may request an alternate payment method or approved shipping address as a condition of accepting an order.

6. SHIPPING & DELIVERY

Shipping is governed by our Shipping Policy, which is incorporated into these Terms.

MORGVN may decline to ship to an address that cannot be satisfactorily verified or that creates unacceptable security, fraud, or insurance risk.

For security and insurance purposes, high-value jewelry generally will not be shipped to freight forwarders, package-forwarding or reshipping services, commercial mail receiving agencies, virtual mailboxes, private mailbox facilities, or similar third-party receiving locations.

Requests to change a shipping address after an order has been placed may require additional verification and may not be permitted.

MORGVN is responsible for an insured shipment while it is in transit to the approved delivery address. Responsibility transfers to the purchaser following confirmed delivery to that address, subject to applicable law.

7. RETURNS & REFUNDS

Returns, refunds, exchanges, cancellations, and final-sale items are governed by our Return & Refund Policy, which is incorporated into these Terms.

Standard made-to-order products are subject to the return and cancellation provisions disclosed in that policy and on the applicable product page.

8. CUSTOM, BESPOKE & MADE-TO-ORDER JEWELRY

Custom, bespoke, resized, engraved, personalized, altered, and special-order jewelry may be subject to different cancellation and return restrictions than standard merchandise.

Any material terms specific to a custom project, including design approvals, deposits, sourcing costs, production estimates, and payment schedules, may also be communicated separately in writing and will form part of the agreement for that project.

Production timelines are estimates unless MORGVN expressly agrees otherwise in writing.

9. CLIENT-SUPPLIED & HEIRLOOM MATERIALS

MORGVN may agree to work with client-supplied gemstones, diamonds, jewelry, or heirloom materials.

Previously worn, antique, heirloom, and client-supplied materials can contain hidden damage, prior repairs, fractures, treatments, wear, structural weaknesses, or other conditions that may not be apparent before work begins.

Work such as stone removal, resetting, repair, sizing, soldering, cleaning, polishing, or other jewelry processes can reveal or exacerbate preexisting conditions.

MORGVN will exercise reasonable professional care when handling client property and will communicate material concerns identified during the course of the work when reasonably possible.

Specific project terms may address the handling, valuation, insurance, replacement, or allocation of risk associated with client-supplied property.

10. CARE, WEAR & REPAIRS

Fine jewelry requires appropriate care and maintenance.

Normal wear, scratches, finish changes, worn prongs, stretched or damaged chains, stone loosening, accidental damage, improper storage, exposure to chemicals, and damage resulting from misuse or third-party repair are not manufacturing defects.

Repairs, maintenance, and service may be available by arrangement.

11. INTELLECTUAL PROPERTY

All content made available through the MORGVN website, including jewelry designs, photographs, graphics, logos, text, video, illustrations, branding, and other creative material, is owned by or licensed to MORGVN and is protected by applicable intellectual-property laws.

No content may be copied, reproduced, distributed, commercially exploited, or used to create derivative commercial products without prior written permission, except as permitted by law.

Purchase of a piece of jewelry does not transfer intellectual-property rights in the design.

12. THIRD-PARTY SERVICES

Our store may use or link to services operated by third parties, including Shopify, payment providers, shipping carriers, social-media platforms, and other technology providers.

Use of third-party services may be subject to the terms and privacy practices of those providers.

13. USER SUBMISSIONS

If you voluntarily provide photographs, testimonials, reviews, comments, or other content to MORGVN, you represent that you have the right to provide that material.

MORGVN will not use client-submitted photographs or personal materials for public marketing in a manner requiring permission without obtaining appropriate authorization.

14. PROHIBITED USES

You may not use our website or services to engage in fraud, impersonation, unauthorized payment activity, infringement of intellectual-property rights, malicious technical activity, unlawful conduct, or interference with the operation or security of the website.

15. DISCLAIMER

Except as expressly stated by MORGVN or required by applicable law, products and services are provided without additional warranties beyond those that cannot lawfully be excluded.

Nothing in these Terms excludes warranties, guarantees, rights, or remedies that cannot legally be waived or limited.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, MORGVN will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or purchase or use of our products or services.

Nothing in these Terms limits liability that cannot lawfully be excluded or limited.

17. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold MORGVN harmless from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the website, violation of these Terms, or infringement of another person's rights.

18. SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

19. WAIVER & ENTIRE AGREEMENT

Failure by MORGVN to enforce a provision of these Terms does not constitute a waiver of that provision.

These Terms, together with the policies incorporated by reference and any applicable written terms for a custom or private-client project, constitute the agreement between MORGVN and the purchaser concerning the applicable transaction.

20. GOVERNING LAW

These Terms and any separate agreements through which MORGVN provides products or services will be governed by and construed in accordance with the laws of the State of Colorado and applicable federal law, without regard to conflict-of-law principles.

Nothing in these Terms limits any mandatory consumer rights or protections that may apply to a customer under the laws of the jurisdiction in which they reside.

21. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our practices, services, or legal obligations.

The version posted on our website at the time of a transaction will generally apply to that transaction, except where otherwise required by law.
